Something being a "social construct" doesn't mean it isn't very real in it's manifestation. Rights are safeguards, essentially an expression of "I don't want you to do X to me, so I assert that I have the right to not be X'd", of course it requires actual force to back up such an assertion.
When assertion and power combine we get material rights, regardless of how idealist they may be.

Just to troll a bit, Slaves in the US enjoyed more material comforts and sometimes more freedoms than Africans living still in Africa at the time. Does that make it right? Who cares.
