I haven't been posting here much lately, I've been really busy with some legal circumstances and it looks like I'm likely to spend some time in prison.
I have a grow journal here somewhere that I never completed and I feel obligated to do that, I figured I'd also make a post explaining the circumstances.
I'm 27 years old and it seems likely that I may be getting a 12-year sentence. Two years are to be suspended to probation and 10 served, but with local state laws, I'll be out in about 5 years.
For cannabis. Not cultivating. Not dealing. Possession of marijuana over 30g within 1000ft of a school, intent to distribute within 1000ft of a school (lol! I was giving it away. Free. My uncle suffers from Chron's disease and relies on my meds for pain), operating with controlled metabolites in system (failed drug test)
The problem is, the prosecutor isn't offering me any deals. The only deal he offered is a 15-year-cap, meaning the sentence is up to the judge, but no more than 15 years. With my criminal background, my attorney said I'm likely looking at 10-12.
Just felt like I should publish what I feel is a great injustice. Grow on, guys. Be safe.

Wow man that is complete bullshit... I saw Where The Buffalo Roams, in which an attorney tries to defend hippies, they get like 5 years for 1 joint...etc. I thought such abusive sentences were over, but seems like it isn't...
Man I really hope shit goes well for you, and also I hope you won't get 10 fucking years for such thang...

move out of state i would rather lave the country or something rather then be stuck in a cage for 10 years.

Also 10 years for 30 grams? If you don't mind me asking where do you live? And exactly what type of criminal background do you have? A buddy of mine got popped for 30 grams a scale and paraphernalia and all he got was a few months probation. Didn't exactly have the best record either

Depends on were he lives, if there is a MMS(Mandatory Minimum Sentence) involved then the scary shit they tell you gets scarier, because it can be true.
In Florida they say shit all the time to scare you that your going to get a heavier charge. Sad thing is, most of the time there is a MMS involved and you end up looking at 10-15 years for somthing that would be probation or 1-3 years any where elts.

around here for non violent drug charges you'll do 1/2 of the minimum you get.
someone i know got a 10 do 5, ended up only serving 24 months.
but theres some new push to get all drug offenders in prison home, and to keep new ones in county and have prison for murderers, rapists, armed robbers etc etc

I was pulled over with a little over 2000g - roughly 4.5 lbs. My criminal background consists of one major incident where I picked up several felonies - Cultivation of Marijuana, Possession of a firearm in commission of another felony, resisting arrest, felony evasion with a vehicle, felony intimidation of a police officer, maintaining common nuisance, dealing in marijuana, reckless possession of paraphernalia, and a bunch of petty misdemeanor shit. Hired the best lawyer around and got 2 years on that.
I'm in Indiana. The reason I'm facing so much time is that the prosecutor wants to run my sentences consecutively rather than concurrently. So instead of facing all the charges at once - he wants me to do them one after another.
I've been to prison, and I don't look forward to going back if that's the case, but the die is cast and things are out of my hands at this point.
Running is out of the question. I'd rather just get my time over with like a man and get back out rather than living on the run for a few years only to inevitably get caught and transported back.
Realistically if I get sentenced to 12 years, suspend two to probation - that's a 10 do 5 with our prison laws (each day counts as 2 days unless you fuck up, that's how "good time" works). We're also allowed to get time cuts for taking classes and stuff in which I could probably manage to get another 12-18 months knocked off from taking substance abuse classes or whatever. Can't do the educational program because I've got a college degree.
It's up to the Judge, really. Prosecutor knows what he wants, and that's a whole lot of time. Not going to take it to trial - I'm guaranteed to lose. They found the bud in my vehicle while I was driving it. Rock solid if you ask me. I was just really hoping the prosecutor was going to offer me some kind of a deal per usual.
Going to fight to get house arrest at the least. I'm not a dealer, I was helping someone. Sure, I'm in the wrong place to be doing that since it's illegal in this state, but there was absolutely nothing in it for me, there was no victim (one can argue that a drug dealer's customers are his victims.) I have a pretty decent job and pay my taxes. So it's just up to the Judge to decide whether or not its in the best interest of society as a whole for me to be locked away or not.

If I were in your shoes, I'd fight it tooth and nail. You can either resignedly let the system stomp your ass or you can become THE activist for your state of Indiana.
Besides, if Ron Paul becomes president you might get out anyway.
