 So I just got arrested

For public intox and theft in the fifth. Even though I didnt steal anything....I picked up some insulation and walked a little way with it then my girlfriend put it back. And then some asshole came out and came up to me and said "you're stealing you're stealing" and I was like "what im not stealing" and he ran inside a gas station and called the cops which just happend to be around the corner. That and they broke my finger....pics coming soon.

Being a cop would be kinda cool, but dealing with little punks would make me pretty mad if I was a cop. I would give the kid a warning unless he was a dick to me. Just thought to share

If he were to sue, how could he possible put up a case without any substantial evidence, surely they could just say that it happened before or after the incident?

Ya thats what they would say in fact....its the cops they suck. I had the EMTs come to the booking place and look at my finger and they said I should have it looked at but I didnt have any money. So they told me they were like 100% sure it was broken cuz it angles. So now I dont know what to do. I dont have any money and finger injuries are a bitch. Plus I cant tie my shoes lol.

his GF could be a witness. Maybe there was a surveillance camera shooting it. Or the cruiser video. If it was obvious that it was broken during the interaction with the police officer i'd talk to a lawyer. just a thought. that's shitty though. Why did you pick up this insulation? What's considered public intoxication? Just saying something unreasonable could be construed as public intoxication i would think. I think people should be as drunk or as high as they want in public so long as they aren't fucking with people or disrupting the peace and flow. where you being obnoxious in any way? do you have an emo haircut?

You should go back to the police department today and file and excessive force complaint against the officer who arrested you. You must do this as fast as possible for it to look right in court. You may be lucky enough to get the charges dropped.

Exactly, if they didn't read him his rights, then he should just see the DA and get the court date dropped.
As far as a lawyer they can't take that right from you ever.
I would get the DA to drop it and find a good lawyer and sue the fuck out of them.
Then move because the cops will have a hard on for you from then on out.

Well I will call the DA tomorrow but I wont get the charges dropped. All that would happen is they wouldnt be able to use what I said in court or anything.

Update so I just got done at a hand doctor and the verdict is that I broke my joint in my finger. And the only way to fix it is to put pins in it. He said that it is going to take a lot of rehab before its back to normal if it ever is back to normal. And that pisses me off cuz I play guitar and my left hand is the one I use to form notes. Wish me luck with surgery tomorrow morning.

did the charges stick? also you ONLY have to be read your miranda rights if they are to question you or if they will be using something you said in court. now heres your argument i dont see that you were charged with resisting arrest soooo why did the officer have to use such excessive force to break your fkin hand to arrest someone that wasnt putting up a fight, you need to contact a street lawyer asap. police departments are more likely to settle out of court as well because the media loves police brutality and they just give you taxpayer money... at worst the officer that did this will get 2 wks paid leave and the taxpayers will pay that too....

Ha ha you cant see the break cuz the doc did his job. lol. It was broken above the pins actually in a jagged line by the disk. But the part that you are seeing is from the break it pushed that bone out.

Dude I was pretty much asking for it, me and two people "A" and "B" left this party and 3 cops were waiting around the corner. Instead of high-tailing it back to the house, we just took one for the team.
They gave "A" a DUI and "B" and I were stranded in Hunington Beach until 7AM. No charges or anything for me, I'm waiting to see what happened to "A".
Fun night that ended so horribly.  Hows the finger?

I just had an experience with pedophile trying shit with my step-son. This dude had been convicted in California for statutory rape of a minor under 16. Spent time in Oklahoma prison for manufacture and distribution of meth. spent 12 years. got out of prison, robbed a home at gun point. has 2 warrants from that incident out of Oklahoma for felon in possession of a firearm and burglary. Came out here and i rented him a room. a year later he propositions my step son to see his penis. I confront him he gets mad, tried to attack me with a mag light. So we fight, he gets his ass kicked by me and my wife. Wife calls cops, they try arresting me for assault but didn't. They arrested him for a gay charge of sexual harassment and assault on me. They let him out on a $50 bail, he's back on my property that night. We get a restraining order and have him removed from the property permanently. He goes to court, plea bargains it to just the assault. Gets 1 year probation with a delayed sentence of 1 year. Gets all the standard warnings about the child incident and also has to file as a sex offender here in Hawaii, Since he was supposed to have done this on his arrival to the island,as part of his previous rape case. Leaves the island before he registers and now he is out probably back in Oklahoma doing this to other kids! The best part is, that sexual predators have one of the highest repeat offender statuses!

sigh, i dont want to argue about it but i know im right and i doubt your professor specializes in criminal justice, however its not just one website it is tens of thousands that will tell you im right, and mirandas laws do vary in states only on how they must be read, they all mean the same thing..... ive been convicted of poss of cannabis and was never read my rights during the arrest or later in the proscecution, i tried to fight this charge on that very defense was quite promptly informed by my attorney that they didnt need to read me my rights because finding the weed in my car was enough to indict me without questioning and that i was fked

thats pretty fked up spacemonkey, in a similar story i had a pistol pulled on me and a girl at a hotel party, the cops had already been called and on arrival the suspect fled and stashed the gun...they caught him and found the weapon, but because the dumb fool loaded the gun with the wrong size bullet he claimed he never had any intention of firing the weapon (why put bullets in it at all then) the next day he too was released on 250$ bail and was at the girls work threating and harassing her the next day...our judicial system is a joke

exactly if u got the money you can slit your wifes throat ear to ear or molest little kids it dont matter, ive been arrested 17 times and convicted twice, every charge i beat was because of money i spend not because i was innocent.....innocent lol
