Ethics aside the mercury content should be enough to call for a ban on fishing for dolphins and other porpoises. Factoring in the animals intelligence and there clearly being abundant sources of food in other forms I think it's unnecessary to keep killing these animals for food.

Its supply in demand, and the firmer you try to control it, the more it goes to the black market, and the more it costs to control. Instead of having semi-legal harvest from which we can both collect scientific data and benefit people with jobs, it would be illegal harvests with no regard for the species.
The only way to stop the harvest is convince the Japanese people that whale isn't food. Good luck.

But we already have this problem with regulated fishing industries. The demand has outpaced the supply in many areas, one of the reasons why Blue Fin tuna is so expensive.
If the supply of fish goes down but the demand still remains high then you will still have a black market with regards to fishing. So rather than concluding that any whaling is illegal you then have to sort through which people are doing it legally and which are doing it illegally, which seems to me would cost more in the long run especially seeing as the demand for whales is relatively low. You also have to sort out and regulate the sale of whale to ensure that it was acquired legally, rather than a total ban which would conclude any whale is illegal. You also have to sort out which species of whale it came from, as this will determine the number of legally caught specimens allowed.
