Two things have to happen for them to have to read you your rights. You have to be in custody (which you were) and you have to be interrogated ie asked questions leading to guilt. That part is up for you to decide.
Alot of people thing that if they are arrested they have to be read their rights but that is not true all the time.
Miranda rights only apply to evidence that comes about as a result of your interrogation. Like say, had they detained you, and found marijuana through interrogation but didn't read you your rights then you could maybe get off. But you having marijuana in plain sight gave them the right to detain you.
At least that's how I remember it. You also have to remember, it's you and your friend's word against the officers. Really numbers don't matter much in this case, you would need outside witnesses; people who aren't in your gang.

I say gang but they're really just co-workers who'd occasionally split a j before parting to the 4 corners of where we live. We're not thugs, just smelly kitchen folk in the more 'concealed' part of the employee parking. I'd say there's a difference between being reckless and having a dime dropped. I don't decide when/where these people somoke. I do have a weakness for it I guess.
Well living in a police state I tell you man, it ain't that great I know it doesn't even matter what I say, but don't you know there's gotta be a better way?
