Alright guys, earlier I was put in cuffs when 2 city boys crept up on my gang. I was holding HALF A JOINT in a parking lot. I was written a misdemeanor ticket even though someone else claimed it as their own. At no point was I notified of my Miranda rights and the ticket has "arrest" selected, they took fingerprints etc. One of the stooges put the joint in my pocket before he walked me and the guy who claimed it around the corner to their pig-mobiles only to take it right back out when I was put in the car. But I was not brought to jail. Do I have leverage here, considering the poor job our city boys did? My financial aid for college is on the line here and it will be a determining factor as to whether I keep my agricultural ambitions. I have multiple witnesses to being put in cuffs without rights read and the joint being put in my pocket and someone else claiming it.
Something's telling me to stay optimistic but I live in a fucketed up state so...

Yes. They parked around the bend of the strip mall at the entrance to the parking lot and walked up on us. I didn't even get to hit it. 
I looked up and saw them like 10 ft away. They said they were there on an 'alarm call' 
Somebody dropped the dime. There were no lights or sirens.

I dunno man, I would try to keep my smokin more low key if I were you. Not in parking lots and shit, know what I'm saying? That way your gang doesn't get crept up on.

That's a bummer....What state do you live in?
Were you brought down to the station?
So glad I can't get caught up any longer in California. Prior to the new law, I have been caught up with smoking or having bud on me and/or my friends...All they did was tell us to be on our way and not to smoke in public parks ...Even handed us back our glass pipes and stash jars  .

Louisiana. It's the only state I know of that's actually trying to pass harsher penalties for 2nd offense marijuana users. If I lose my financial aid, there's really nothing holding me back from leaving these inbred hillbillies. Colorado's looking better every day.
And I wasn't brought to the station.

No Miranda Rights usually means no case. But it is Louisiana
Don't smoke in public where its still strictly illegal. I live in CO, have my medical card, and I still always smoke in my home because I don't like it when pigs are snorting up my spine.

Yeah, that's true. I just try to keep my shit really low key anyway. Probably more than some other people to be honest. Like in the situation with them smoking in the parking lot, I probably would've walked away to be honest. I try not to to do shit like that anymore. Not a teenager anymore, know what I mean?

I know what ya mean. I don't puff outside ever unless its on my patio, and I would definitely never smoke in a parking lot even if I was a teen 
Believe it or not I have been smoking and getting fucked up for 8 years now and I have no drug related offenses. Just a few speeding tickets.

Yea, thanks. I usually just go straight home after work but I haven't smoked in forever, so it was hard to pass up when they're like 'take one toke for the road.' I should've ate it, but I was a little drunk by the time I got off the clock so my judgement was askew.

Were you interrogated to any degree?
Two things have to happen for them to have to read you your rights. You have to be in custody (which you were) and you have to be interrogated ie asked questions leading to guilt. That part is up for you to decide.
Alot of people thing that if they are arrested they have to be read their rights but that is not true all the time.

Miranda rights only apply to evidence that comes about as a result of your interrogation. Like say, had they detained you, and found marijuana through interrogation but didn't read you your rights then you could maybe get off. But you having marijuana in plain sight gave them the right to detain you.
At least that's how I remember it. You also have to remember, it's you and your friend's word against the officers. Really numbers don't matter much in this case, you would need outside witnesses; people who aren't in your gang.

I say gang but they're really just co-workers who'd occasionally split a j before parting to the 4 corners of where we live. We're not thugs, just smelly kitchen folk in the more 'concealed' part of the employee parking. I'd say there's a difference between being reckless and having a dime dropped. I don't decide when/where these people somoke. I do have a weakness for it I guess.
