Of course they can. There is a law that says "the eye cannot trespass" which basically means if they can see something illegal without searching for it (through a car/home window, sticking out of your pocket, etc.) they can charge you based on visible evidence, and they don't need a warrant or your permission to search b/c it is in plain sight.

They almost never will though. That don't mean they won't. Especially if it is VERY visible. If a neighbor complains they almost certainly will.

No shit! I've got one who has a real hard on for me. He has always been an asshole and has quite a reputation for it. He has gotten me arrested once already by harassing the shit out of the sheriff's dept until they filed charges against me on a MJ possession case they had already decided not to pursue.
They didn't have anything on me without him as a witness. I wasn't going to but ended up having to file assault charges against him so that he would agree not to stand as states witness against me.
A week ago I had someone doing some work for me and they temporarily sat a load of brush down on another neighboring property for maneuvering reasons. Dude reported me for illegal dumping. lol Nothing came of it but, damn! lol
He happens to be the phone man too. I bet he has my shit illegally tapped.
I'm the type of person who would rather keep to myself minding my own business and he mind his. I'm trying make that work but he keeps pushing. I hope this situation doesn't end badly.

Thats real shitty tripity. My neighbors are quiet and unaware of anything bad happening at my house lol. Needless to say, NobodyImportant was last seen 15 mins ago so I dont think anything happend haha.

I don't know. I feel like shit like that wouldn't fly in CA.
How can an officer of the law presume that I am not legally medicating? Other than the fact that I hit the bong like a pro, he has nothing against me. Thus, does he truly have the right to persecute?
